employee for a period of at least 15 continuous years
prior to the date of such retirement, he shall be paid by
the City of Hagerstown during the remainder of his
natural life a salary or pension of $80. 00 per month.

Whenever any such driver, tiller, or chauffeur shall
have given meritorious service as such employee for a
period of at least 15 continuous years, he shall be retired
upon the recommendation of the Chief Marshal of said
fire department, provided that after a physical examina-
tion given by three physicians to be selected by said Chief
Marshal and acceptable to the Mayor, it shall be found
that such employee is physically incapable of properly
performing the duties or services required of him, and that
such disability is permanent in its nature, whereupon
such employee shall be paid by the City of Hagerstown
during the remainder of his natural life a salary or pen-
sion of $80. 00 per month.

Whenever, after a physical examination given by three
physicians to be selected by said Chief Marshal and accept-
able to the Mayor, it shall be found that any such driver,
tiller, or chauffeur shall be physically incapable of properly
performing the duties or services required by him and
that such disability is permanent in its nature and is the
direct result of an accident or injury occurring in the
course of duty while actively participating in fighting a
fire or while going to or coming from a fire, then such
employee shall be retired and he shall be paid by the City
of Hagerstown during the remainder of his natural life
a salary or pension of $80. 00 per month. The Council
shall have full power and authority to appropriate and
cause to be raised by taxation a sum of money sufficient
to carry out the provisions of and to pay the salaries or
pensions provided for in this section.

The aforegoing provisions of this section shall apply
only to the retirement and pensioning of any such driver,
tiller or chauffeur as may be in the employ of the City
prior to the date that this section shall become effective,
on and after which date all such employees when employed
shall become members of the Employees' Retirement Sys-
tem of the State of Maryland in which the City now par-
ticipates. Any such driver, tiller, or chauffeur employed
by the City prior to the effective date of this section shall
be privileged to become a member of the Employees' Re-
tirement System of the State of Maryland within the period
time prescribed by and upon compliance with all of the
rules and regulations of the Board of Trustees of said
system, whereupon such employee shall be deemed to have
