such residence is acquired; the voter must vote in the
ward from which he has removed and in which he is
qualified voter. The said Councilmen shall be not under
twenty-five years of age, citizens of the United States,
residents of Hagerstown for five years next preceding the
election, residents and qualified voters of their respec-
tive wards, and shall take the oath of office as herein
prescribed for City Officers. From and after the general
election on the fourth Tuesday in March, 1949, they shall
receive an annual salary of Fifteen Hundred Dollars
($1500. 00) each.
14. (a) In case of a vacancy in the position of Council-
man for any ward, by death, resignation or otherwise, the
Mayor, with the advice and consent of the Council, shall
appoint a person to fill such vacancy for the unexpired
term, the person so appointed to be one who for more
than one year was affiliated with the political party whose
candidate was elected as Councilman for such ward at the
last general election and who possesses all of the qualifica-
tions prescribed for Councilmen.
(b) When any Councilman becomes a member of the
armed forces of the United States, and indicates in writ-
ing to the Mayor his preference to be considered a member
on leave of absence during his service in the armed forces,
then the Mayor, with the advice and consent of the Coun-
cil, shall appoint a substitute Councilman to serve until
the end of the term of such Councilman, or until such
Councilman returns with an honorable discharge from the
armed forces, whichever first occurs. Such substitute
Councilman shall possess all the qualifications prescribed
for other Councilmen, and shall have possessed such quali-
fications for more than one year prior to his selection as
substitute Councilman, and be affiliated with the same
political party as the Councilman for whom he is substi-
tuting. During his term of service, such substitute Coun-
cilman shall receive the pay to which the Councilman for
whom he is substituting would be entitled. The provisions
of this section shall not be taken to extend in any way to
the term of office of any Councilman beyond the period
for which he was appointed or elected.
15. It shall be the duty of the Mayor to publish in at
least one newspaper of general distribution published in
Hagerstown, at least ten days prior to the day of holding
any election in which voters of the City may cast ballots,
notice thereof, which notice shall state the officers to be
voted for, or the object and purposes of such election.
