CHAPTER 561
(House Bill 439)

AN ACT to repeal and re-enact, with amendments, Section 95
of Article 1A of the Code of Public Local Laws of Mary-
land (1930 Edition), as amended by Chapter 21 of the Acts
of 1935, title "City of Cumberland", sub-title "Appropria-
tions", relating to appropriations by the City of Cumber-
land.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 95 of Article 1A of the Code of Public
Local Laws of Maryland (1930 Edition), as amended by
Chapter 21 of the Acts of 1935, title ". City of Cumberland",
sub-title "Appropriations", be and it is hereby repealed and
re-enacted, with amendments, to read as follows:

95. During the month of August in each and every year it
shall be the duty of the Mayor and City Council of Cumber-
land to make appropriations for each and every Department
of the City Government, and also to provide an appropriation
of not more than Twenty-five Thousand Dollars (f25, 000. 00)
to be known as the Contingent Fund, for operating each
and every one of said Departments during the then fiscal
year, and said Departmental appropriations, when so made,
shall not be changed, nor shall any of said appropriations
be overdrawn by any department before April 1st of the
succeeding year; and said Mayor and City Council at the
same time shall have power to appropriate, to be included in
the General Tax Levy, a sum not to exceed four per centum
of the total amounts above mentioned to be appropriated and
this sum shall be known as the Special Contingent Fund
which may be used by any Department of the City for capital
expenditures only as the Mayor and City Council may from
time to time direct and only then when five members of the
Council so authorize its use or any part thereof.

SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1949.
