of said court or magistrate, there shall be the further
penalty of the confiscation of boats, gear and equipment
used or taking part in said violation to the use of the State
wherein the offender may be convicted.

23. (Enforcement. ) The enforcement of the rules and
regulations promulgated pursuant to the authority granted
in this Compact shall be done by the Department
of Tidewater Fisheries of Maryland and the Virginia
Commission of Fisheries, or their respective successors,
or by such other agencies or instrumentalities of either
State as the Legislature thereof may direct.

24. (Jurisdiction. ) Any person not a citizen of either
Maryland or Virginia deemed guilty of violating any of
the provisions of this Compact or of rules or regulations
promulgated hereunder may be tried and punished in either
State by the magistrates or courts having legal juris-
diction of such violations. Any person, a resident of either
the State of Maryland or the Commonwealth of Virginia,
deemed guilty of violating any of the provisions of this
Compact or of rules or regulations promulgated hereunder
may be apprehended and arrested by the appropriate law
enforcement officials of either State, and may be tried
and punished by the magistrates or courts of the State
of the arresting agent or agencies.

25. (Financing. ) The State of Maryland and the Com-
monwealth of Virginia agree to appropriate annually for
the compensation of the members of the Commission and
for the salaries of the employees thereof and for office
and other administrative expenses such reasonable sum or
sums as shall be recommended by the Commission and
approved by the Governors of the said State, each State
to defray one-half of such expense. Compensation of the
Commission shall be on a per diem basis for each day the
Commission is in session plus actual traveling expenses,
except that no extra compensation shall be received by the
heads of the two State Departments of Fisheries.

The Commission shall have authority to make such
charges monetary or in kind against those engaged in
the oyster industry as are reasonable to defray or par-
tially defray the cost of planting and policing oyster
beds in the Potomac River.

27. (Severability. ) Should any part of this Compact
be held to be contrary to the Constitution of either the
State of Maryland or the Commonwealth of Virginia, or
of the United States, all other severable objects of this
Compact shall remain in full force and effect.
