each of the several counties and the Board of School Com-
missioners of Baltimore City eligible to share in the Equali-
zation Fund shall expend no less than twenty per centum
(20%) of the total budget, not including costs of transpor-
tation, debt service and capital outlay, for purposes other
than teachers' salaries. But no such appropriation to any
county, except as heretofore in this section provided, or
to any academy, or to any college or university may be
paid from the General State School Fund.
SEC. 2. And be it further enacted, That this Act shall
take effect on July 1, 1949.

(Senate Bill 334)
AN ACT to repeal and re-enact, with amendments, Sub-
section (i) of Section 5 of Article 72 of the Annotated
Code of Maryland (1947 Supplement), title "Oysters
and Clams", relating to the taking of oysters from the
waters of the Potomac River and its tributaries.
SECTION 1. Be it enacted by the General Assembly of M dryland,
That Sub-section (i) of Section 5 of Article 72 of the
Annotated Code of Maryland (1947 Supplement), title
"Oysters and Clams", be and it is hereby repealed and
re-enacted, with amendments, to read as follows:

(i) Privileges of a Tonging License—Locations. Any
person granted a tonging license in the manner described
in the preceding sub-sections shall be entitled to take or
catch oysters with tongs and patent tongs during the
season for taking oysters as follows: In the waters of the
county wherein such license is granted; and in the waters
of the Chesapeake Bay, except that all waters within one
and one-half miles of Sandy Point, Racket's Point, Tolley's
Point, Thomas' Point, Three Sisters Bar and Holland's
Point Bar shall be considered within the limits of Anne
Arundel County; and the oyster bars of Entrance Lump,
White Marsh, Gum Springs, Hunting Field, Windmill
Flats, Muddy Drain, Swan Point and Lighthouse Lump
shall be considered to lie within the limits of Kent County;
