(b). For the purposes of the Section: (1) an item
received by a bank on a day other than its business day,
or received on a business day after its regular business
hours or during afternoon or evening periods when it has
re-opened or remained open for limited functions, shall
be deemed to have been received at the opening of its next
business day; (2) the term "credit" includes payment,
remittance, advice of credit, or authorization to charge and,
in cases where the item is received for deposit as well as
for payment, also includes the making of appropriate
entries to the receiving bank's general ledger without
regard to whether the item is posted to individual cus-
tomer's ledger; and (3) each branch or office of a bank
shall be deemed a separate bank.

(c). The effect of this section may be varied or modified
by agreement.

SEC. 2. And be it further enacted, That this Act shall
take effect June 1, 1949.

CHAPTER 442
(Senate Bill 216)

AN ACT to repeal and re-enact with amendments Sec-
tion 7 of Article 43 of the Annotated Code of Maryland
(1947 Cumulative Supplement), title "Health", sub-title
"State Board of Health", to transfer the power to re-
move for cause Deputy State Health Officers from the
State Board of Health to the Commissioner of State
Employment and Registration.

SECTION 1. Be it enacted by the General Assembly of Maryland,
That Section 7 of Article 43 of the Annotated Code of
Maryland (1947 Cumulative Supplement), title "Health",
sub-title "State Board of Health", be and the same is hereby
repealed and re-enacted with amendments so as to read
as follows:

7. The Deputy State Health Officers shall be trained
in sanitary science and hygiene, and shall possess the same
qualifications required of the State Health Officer, and
shall hold their office during efficiency and good behavior,
but may be removed, in the manner provided in Section 19
of Article 64A, title "Merit System". No Deputy State
