SEC. 2. " And be it further enacted, That this Act shall
take effect June 1, 1949.

CHAPTER 429

(Senate Bill 138)

AN ACT to repeal and re-enact, with amendments, Sec-
tion 868 of Article 4 of the Code of Public Local Laws
of Maryland & Baltimore City Charter (1938 Edition),
title "Baltimore City", sub-title "Police Commissioner",
as said section was amended by Chapter 830 of the Acts
of 1943, increasing the compensation of the Police Com-
missioner of Baltimore City and clarifying the provision
as to his contribution to the Police Pension Fund.

SECTION 1. Be it enacted by the General Assembly of Maryland,
That Section 868 of Article 4 of the Code of Public Local
Laws of Maryland & Baltimore City Charter, (1938 Edi-
tion), title "Baltimore City", sub-title "Police Commis-
sioner", be and it is hereby repealed and re-enacted, with
amendments, to read as follows;

868. There shall be appointed by the Governor on June
1, 1949, and every six years thereafter, one discreet
person, resident or engaged in business in the City of Balti-
more for three consecutive years next preceding the day of
his appointment, who shall be known as the Police Commis-
sioner for the City of Baltimore, and whose term of office
shall continue for six years and until his successor is ap-
pointed and qualified. If a person appointed Police Commis-
sioner is a member of a Retirement or Pension System of the
State of Maryland or City of Baltimore, he shall have the
right to continue as a member of such system, with all the
rights, privileges and benefits which the members of such
system may have as to retirement on pension or the payment
of pension or other benefits to his widow or other beneficiary,
provided he continues to pay the same rate of contribu-
tion to such retirement system or pension fund which he
was paying when he became Police Commissioner. Upon
ceasing to be Police Commissioner, such person shall
have the right to be retired on pension, with all the rights
and privileges of the system of which he is a member,
without any regard to the age requirements or the re-
quirements for physical examination required by such sys-
tem, provided the total combined service prior to becoming
