State Government authorizing him to engage in the par-
ticular class of flight instruction in which he is engaged,
which has been recorded with the Commission and such
recordation with the Commission is in full force and effect.

(e) Licensing of Airports and other Air Navigation
Facilities. All proposed airports, restricted landing areas,
and other air navigation facilities shall be first licensed by
the Commission before they, or any of them, shall be used
or operated. Any political sub-division or person acquiring
property for the purpose of constructing or establishing an
airport or restricted landing area shall, prior to such acqui-
sition, make application to the Commission for a certificate
of approval of the site selected and the general purpose
or purposes for which the property is to be acquired, to
insure that the property and its use shall conform to mini-
mum standards of safety and shall serve public interest.
Provided, however, that if (1) any municipality with a
population of 100, 000 or more plans to acquire a site for
an airport to be owned, used and operated by it and has
prior to the passage of this Section entered into any com-
mitments or negotiations for the acquisition of any prop-
erty for that purpose or for the development of any plans
for the construction and operation of such airport, and (2)
such airport is designated by the appropriate Federal
Authority and (3) no State funds are used for the plan-
ning and designing, acquisition, construction, operation
or maintenance of said airport, then the State Aviation
Commission shall issue a license for such airport as herein
provided, without regard for the standards for issuing cer-
tificates of approval and licenses set forth in Sub-section (f)
of this Section.

Provided further, that nothing herein shall contravene
the zoning laws or regulations now or hereafter outstand-
ing in any political sub-division or sub-divisions of the
State, it being the intention of this Act that such zoning
laws or regulations shall be observed and enforced in the
administration of this Act.

It shall be unlawful for any political sub-division or offi-
cer or employee thereof, or for any person, to operate an
airport, restricted landing area, or other air navigation
facility for which a license, issued by the Commission, is
not in effect.

(f) Standards for Issuing Certificates of Approval and
Licenses. In determining whether it shall issue a certifi-
cate of approval or license for the use or operation of any
proposed airport or restricted landing area, the Commis-
sion shall take into consideration its proposed location, size
