SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Sections 1 and 2 of Article 89B of the Annotated
Code of Maryland (1939 Edition), title "State Roads", be and
they 'are hereby repealed and re-enacted, with amendments, to
read as follows:
1. The head of the Department of Public Works shall be
the State Roads Commission, which shall consist of three
members, to be appointed by the Governor, one of whom he
shall designate as Chairman and be known as the Director
of the Department. One of said members shall be a resident
of the Eastern Shore of Maryland, one a resident of the
counties of the Western Shore of Maryland and one a resi-
dent of Baltimore City. At least one member of said Com-
mission shall bona fide belong to or be affiliated with that one
of the two leading political parties in the State opposite to the
party to which the Governor belongs. The term of office of the
members of said Commission shall be six years, but of those
first appointed, one shall serve for two years, one for four
years and one for six years from June 1, 1945. The Governor
shall have the power to fill any vacancy caused by death,
resignation, incapacity, removal or other cause. The members
of said Commission shall take the oath prescribed by Article 1,
Section 6 of the State Constitution and shall receive such com-
pensation as may be provided for in the Budget. A majority
of the members of said Commission shall constitute a quorum
for the transaction of business. The Chairman shall preside
over its meetings and perform such other duties as may be im-
posed upon him by law or as may be assigned to him by said
Commission.
The members of said Commission shall elect a Secretary,
not a member of the Commission, who shall receive such com-
pensation as the Commission may determine and as may be
provided in the Budget. He shall make and carefully preserve
full and accurate minutes of all meetings and records of all
proceedings and enter same in the journal of the Commission.
The Secretary shall make true copies of all notices directed
by the Commission to be published and the certificates of pub-
lication thereof, and shall perform such other duties as may
be imposed upon him by law or as may be assigned to him by
the Commission.
2. All records of said Commission shall be public rec-
ords, and the Commission shall annually, make to the Gov-
ernor a detailed report of its official transactions, and of all
its expenditures and of all liabilities incurred by it. The
said Commission may employ such chief engineer, assistant
engineer, professional or technical experts, surveyors, agents,
assistants, clerks, employees and laborers, skilled and un-
