follow immediately after Section 64 of said Article, relating
to the licensing of tree experts.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That eight new sections be and they are hereby added
to Article 39A of the Annotated Code of Maryland (1943
Supplement), title "Forestry", to be under sub-title "Tree
Experts", said new sections to be known as Sections 65-72,
inclusive, to follow immediately after Section 64 of said
Article, and to read as follows:
65. (Definitions). As used in this sub-title:
"Tree Expert" means a person skilled in the science of tree
care who, whether in his own business or as the employee of
another and whether under the title of arborist, silviculturist,
tree specialist, tree surgeon, tree expert or otherwise, devotes
the regular business hours of the day to the treatment and
care of trees, that is to say, making diagnoses, and prescribing
and supervising treatment for trees, for compensation.
"Certified Tree Expert" means a person who has received
from the Commission of State Forests and Parks a Certificate
of his qualifications to practice as a tree expert.
66. (State Forester Agent of Commission). The Commission
of State Forests and Parks, or its duly authorized agent, is
hereby authorized to examine applicants for certification as
tree experts and to pass upon their competency as such. The
State Forester as administrative head of the Department of
State Forests and Parks shall be deemed to be the duly author-
ized agent of the Commission of State Forest and Parks.
67. (Issuance of Certificates; Qualifications). The Com-
mission of State Forests and Parks shall issue and grant a
"Certified Tree Expert" certificate to any applicant, who, in
the opinion of the Commission, has qualified by the following:
(1) who pays the fees hereinafter provided;
(2) who is a citizen of the United States or who has duly
declared his or her intention of becoming such citizen;
(3) who is over the age of twenty-one years;
(4) who is of good moral character;
(5) (a) who has had four years of approved college educa-
tion, preferably in forestry, landscaping or agricul-
ture, or the equivalent; or
(b) who, in the opinion of the Commission has had
sufficient professional experience in tree care to
justify waiver of the requirement of four years of
college or an equivalent education; or
