SEC. 5. And be it further enacted, That this Act is hereby
declared to be an emergency law and necessary for the imme-
diate preservation of the public health and safety, and being
passed upon a yea and nay vote supported by three-fifths of
all the members elected to each of the two Houses of the Gen-
eral Assembly, the same shall take effect from the date of its
passage.

CHAPTER 342.
(House Bill 291)
AN ACT to repeal and re-enact, with amendments, Section 6
of Article 45 of the Annotated Code of Maryland (1939 Edi-
tion), title "Husband and Wife", providing that the right of
dower shall not attach to lands held by two or more persons
as joint tenants while such tenancy exists.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 6 of Article 45 of the Annotated Code of
Maryland (1939 Edition), title "Husband and Wife", be and
it is hereby repealed and re-enacted, with amendments, to read
as follows:
6. A widow shall be entitled to dower in lands held by
equitable as well as legal title in the husband at any time
during the coverture, whether held by him at the time of his
death or not, but such right of dower shall not operate to the
prejudice of any claim for the purchase money of such lands,
or other lien on same. Provided, however, that no right of
dower shall attach to any lands held by any two or more per-
sons as joint tenants while such tenancy exists.
SEC. 2., And be it further enacted, That this Act shall take
effect June 1st, 1945.
