SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1945.

CHAPTER 295.
(House Bill 29)

AN ACT to repeal and re-enact, with amendments, Section
15 of Article 88B of the Annotated Code of Maryland (1939
Edition), title "State Police", authorizing the Superintend-
ent of State Police to demote in rank employees below the
rank of commissioned officer.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 15 of Article 88B of the Annotated Code
of Maryland (1939 Edition), title "State Police", be and it is
hereby repealed and re-enacted, with amendments, to read as
follows:

16. The Superintendent shall have full power and authority
to suspend, for a period of thirty days, without pay, any em-
ployee of the Department for such cause as may seem fit to
him. The Superintendent shall have full power and authority
to demote in rank any employee of the Department below the
rank of commissioned officer, for such cause as may seem fit to
him. The Superintendent may demote any commissioned officer,
for cause, if charges are preferred, in accordance with the pro-
visions of the Merit System, and no such demotion shall bet
final until after a hearing has been held in accordance with
the provisions of the Merit System. The findings of the State
Employment Commissioner shall be binding upon the Super-
intendent. The Superintendent may discharge any employee
of the Department for cause, if charges have been preferred,
in accordance with the provisions of the Merit System, and
no such discharge shall be final until after a hearing has been
held in accordance with the provisions of the Merit System.
The findings of the State Employment Commissioner shall
be binding upon the Superintendent, The Superintendent shall
have full power and authority to suspend or discharge pro-
bationers without a hearing.

SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1945.
