diate preservation of the public health and safety and having
been passed upon by yea and nay vote, supported by three-
fifths of all the members elected to each of the two Houses of
the General Assembly of Maryland, the same shall take effect
from the date of its passage.

CHAPTER 27.
(House Bill 1)

AN ACT to repeal Section 404 of Article 27 of the Annotated
Code of Maryland (1939 Edition), title "Crimes and Pun-
ishments", sub-title "Liquor, Dealers—Giving Away of Pood
By", and to add a new section to Article 2B of said Code
(1943 Supplement), title "Alcoholic Beverages", sub-title
"Regulations and Restrictions", said new section to be
known as Section 34C and to follow immediately after Sec-
tion 34B of said Article, prohibiting the giving away of food
by persons licensed to sell alcoholic beverages.

WHEREAS, Section 404 of Article 27 of the Annotated Code of
Maryland (1939 Edition), title "Crimes and Punishments, "
sub-title "Liquor Dealers—Giving Away of Food By", makes
it unlawful for dealers in alcoholic beverages to give away
food; and

WHEREAS, in so far as practicable, all provisions relating to
dealers in alcoholic beverages should be in Article 2B of the
Code; therefore

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 404 of Article 27 of the Annotated Code
of Maryland (1939 Edition), title "Crimes and Punishments",
sub-title "Liquor Dealers—Giving Away of Food By", be and
it is hereby repealed.

SEC. 2. And be it further enacted, That a new section be
and it is hereby added to Article 2B of said Annotated Code
of Maryland (1943 Supplement), title "Alcoholic Beverages",
sub-title "Regulations and Restrictions", said new section to
be known as Section 34C, to follow immediately after Section
34B of said Article, and to read as follows:

34C. Any person engaged in the sale or barter of spirituous,
malt or intoxicating liquors, and licensed under the laws of
