shall issue subpoenas for witnesses for either party, except
where he is required to proceed ex parte; and he shall cause to
come before him all witnesses subpoenaed, at the time ap-
pointed, to be examined; and their attendance and duty to
testify may be enforced by attachment, to be issued and re-
turned as provided in Section 299.

SEC. 2. And be it further enacted, That this Act is hereby
declared to be an emergency law and necessary for the imme-
diate preservation of the public health and safety and having
been passed upon by yea and nay vote, supported by three-
fifths of all the members elected to each of the two Houses of
the General Assembly of Maryland, the same shall take effect
from the date of its passage.

CHAPTER 1028.
(House Bill 548)

AN ACT to add a new section to the Code of Public Local
Laws of Montgomery County (1939 Edition), being Article
16 of the Code of Public Local Laws of Maryland (1930 Edi-
tion), title "Montgomery County", sub-title "Roads", said
new section to be known as Section 865A, and to follow im-
mediately after Section 865, providing that whenever the
County Commissioners for Montgomery County alter, re-
locate, or close any public highway, avenue, street, lane, or
alley, that the proceedings shall be recorded on the Land
Records for Montgomery County.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That a new section be, and it is hereby added to. the Code
of Public Local Laws of Montgomery County (1939 Edition),
being Article 16 of the Code of Public Local Laws of Maryland
(1930 Edition), title "Montgomery County", sub-title "Roads",
said new section to be known as Section 865A, and to follow
immediately after Section 865, and to read as follows:

865A. Whenever the Board of County Commissioners for
Montgomery County shall alter, relocate, or close any public
highway, avenue, street, lane, or alley the proceedings shall be
recorded in the office of the Clerk to the Circuit Court for
Montgomery County and spread upon the Land Records for
Montgomery County, and that the cost of recording such pro-
ceedings shall be collected by the Board of County Commis-
