and to other circumstances shall be affected thereby. If any
provision, clause, sentence, word, phrase, or part of this Act
shall be declared to be in violation of any provision of the State
or Federal Constitutions, the remainder of said Act shall
stand and be effective notwithstanding. To the extent, and
only to the extent, of a judicial declaration of unconstitution-
ality or invalidity as to a given person, firm, or corporation,
or as to a given factual situation, the provisions of the law
prior to the passage of this Act shall remain in full force and
effect solely for the enforcement of rights as to such person,
firm, or corporation, or as to such factual situations.

SEC. 10. And de it further enacted, That this Act is hereby
declared to be an emergency law and necessary for the imme-
diate preservation of the public health and safety and being
passed by a yea and nay vote, supported by three-fifths of the
members elected to each of the two Houses of the General
Assembly, the same shall take effect from the date of its
passage.

(House Bill 496)

AN ACT to repeal and re-enact, with amendments, Sub-section
(6) of Section 8 of Article 23 of the Annotated Code of
Maryland (1939 Edition), title "Corporations", sub-title
"Provisions for Formation of Corporations—Powers", relat-
ing to corporate powers and clarifying the existing law.

WHEREAS, it has been the legislative intent and understand-
ing that corporations incorporated under the provisions of
Article 23 of the Annotated Code of Maryland (1939 Edition),
have and have had the power to make gifts and contributions,
unless otherwise restricted by their charters or by-laws for
religious, charitable, scientific, civic, literary, educational and
public purposes; and

WHEREAS, it is the desire of the General Assembly of Mary-
land to clarify and declare the existing law with respect
thereto; therefore

SECTION 1. Be it enacted by the General Assembly of Mary-
Tandy That Sub-section (6) of Section 8 of Article 23 of the
Annotated Code of Maryland (1939 Edition), title "Corpora-
