license to be in the nature and form of a contract between the
State of Maryland and the applicant, and shall provide for the
payment of a license fee of Twenty-five Dollars ($25. 00), and
shall further provide that the licensee shall turn over to the
State of Maryland at least ten percent (10%) of the shells
from the oysters shucked in his establishment for the current
season, said shells to be removed on or before the twentieth
day of August following; or at the discretion of the Commis-
sion, its equivalent in money, the value thereof being deter-
mine at the market value of shells as of the first day of May fol-
lowing the close of the season. The said Department shall notify
each packer or canner on or before the first day of May whether
it is its intention to take the ten per cent (10%) of the shells
from oysters shucked as aforesaid, or its equivalent in money.
Said license shall have effect from the first day of September
in the year in which it may have been obtained until the twenty-
fifth day of April, inclusive, next succeeding.
(b) Season for Packing Oysters. It shall be unlawful for
any person to take or catch oysters or to have oysters in his
possession between the fifteenth day of April to the first day
of September each year, except that oysters caught on or
before the fifteenth day of April may be kept in possession
through the twenty-fifth day of April; provided, however, that
oysters may be taken by dredge or hand scrape at any time in
Worcester County and may be shipped in the shell at any time
within or from said County.
(c) Disposition of Packers' License Fee. All moneys re-
ceived from packers' licenses shall be paid over to the Comp-
troller of the Treasury to be credited to the Oyster Fund.
(d) Disposition of State's Portion of Shells. All shells re-
ceived by the Department of Tidewater Fisheries under the
provisions of this section shall be transplanted upon such
oyster bars of the State as may be reserved by said Department
in accordance with the provisions found in Section 11 of this
Article; and all money paid by packers in lieu of the State's
portion of shells shall be expended in the purchase of shells or
seed oysters, likewise to be planted upon such reserved areas.
10. OYSTER MEASURES.
(a) Measures Used for Oysters in the Shell and Oyster Shells.
All oysters in the shell and all oyster shells sold in this State
shall be measured either in a half bushel tub, a bushel tub,
a bushel and a half tub or a three bushel tub, and no measures
shall be used for measuring either oysters in the shell or oyster
shells except an iron circular tub with straight sides and a
straight solid bottom, with holes in the bottom for draining;
