such petition. No person shall be deemed a candidate, nor shall
his name be placed upon the ballots, unless the provisions of
this paragraph shall have been complied with.

(P) That after the polls are closed on the night of election,
the Board of Election Supervisors shall count the votes, and
the three candidates who shall have received the greatest num-
ber of votes shall be deemed to be elected Commissioners.
In the case of a tie vote a run-off election shall be held to
choose between the tied candidates, such election to be called
by the Election Supervisors at the earliest date such election
can be legally held. And in counting the votes, no ballot shall
be rejected because the voter casting the same shall have voted
for only one candidate.

(Q) That after the ballots and votes have been counted, and
the result ascertained, said Board of Election Supervisors
shall within twenty-four (24) hours, certify to the Morning-
side Commission the result of such election, stating the names
of the candidates and the number of votes cast for each, and
shall within the same period, post at least one copy of such
certificate at the regular meeting place of said Commission.
Such certificate shall be signed by each member of said Board
of Election Supervisors. Provided, however, that failure on
the part of said Board to make such certificate or to post
copies thereof, or failure 'to do both of these acts, shall not
invalidate such election. If said Board shall so fail to make
such certificate, and post copies thereof then it shall be the
duty of the Morningside Commission to make such certificate
and post such copies thereof.

(K) That after said Board shall have counted the ballots
and votes, and ascertained the result of the election, said
Board shall file with the Morningside Commission all records
and books in connection with such election.

(S) That each of the Commissioners so elected shall on or
before the third Monday in May of the year when he shall
have been elected, qualify as such Commissioner by taking an
oath of office as prescribed by Paragraph J of Section 3 of
this Act.

(T) That in case any person so elected to the office of Com-
missioner shall fail to qualify, or in case of any vacancy in the
office of Commissioner by death, resignation or otherwise, the
remaining Commissioners shall fill such vacancy by appoint-
ment. Any person so appointed shall possess the qualifications
stated in this Act, shall be a resident of the Town of Morn-
ingside, and shall qualify by taking the oath of office within
three (3) days after said appointment.
