to the number of horses drawing the same; for every
cart or wagon, the wheels of which are under four
inches tread or breadth, six cents; for every horse,
mule or ox drawing the same, for every cart or wa-
gon, the wheels of which exceed four inches in
tread or breadth, and not over five inches, three
cents, for every horse, mule or ox drawing the same,
and for every cart or wagon, the breadth of wheel
being six inches, two cents for each horse, mule or

ox drawing the same; Provided, that the tolls be-
fore mentioned, shall not be charged or collected
on said road in the manner hereinbefore directed,
nor any person, their wagons, carts, carriages or
other vehicle, or animals be compelled to pay the
aforesaid toll for passing through the said gate, on
said road, more than once a day who is the holder
of two hundred dollars of the stock of said road;
And provided further, that the said president and
directors shall not in any one year divide and dis-
tribute amongst the stockholders an amount of the
money received for tolls exceeding five per centum
on the stock held by them respectively, but shall
apply the residue of earnings, after making such
dividend, to the further improvement of said road,
its bridges, culverts and keeping the same in as com-
plete repair as possible with the amount of funds in
hand after deducting and paying a sum sufficient to
pay officers' salaries and incidental expenses.

Provisos.

SEC. 12. And be it enacted, That if any person or
persons shall drive any carriage or wagon, or cart
or other vehicle of burthen around said toll-gate
with the intention to avoid the payment of toll,
and if any person or persons shall lead, drive or
ride his horse, or any horses, mule or mules, ox or
oxen, hog or hogs, sheep or cattle, or other ani-
mals chargeable with toll, around said toll-gate
with intent to evade the payment of the toll for
which they would have been chargeable if they had
offered to. pass through said gate, such person, if a
freeman, shall forfeit and pay two dollars for every
such offence, if a minor, his father, mother, mas-
ter or guardian shall forfeit and pay one-half the
foregoing amount, and if a steward or slave, his or
her master or mistress shall forfeit and pay a like
sum, to be recovered as small debts now are or may
be recovered.
