company for such year, and special meetings of the
stockholders may be called by order of the direc-
tors or by stockholders holding one-fifth in amount
of the capital stock, by like notice as that required
for annual meetings, specifying moreover, the ob-
ject of the meetings, but no business shall be trans-
acted at such special meetings, unless a majority
in value of the stockholders shall attend in person
or by proxy.

CHAP. 138.

SEC. 12. And be it enacted, That the said com-
pany be, and they are hereby authorised to locate
and construct a railroad from some convenient
points at the limits of the city of Baltimore, to be
selected by them, to Towsontown, in Baltimore
county, over the road of the Baltimore and Yorktown
turnpike road company, or such other route as they
may select, and for such purpose may enter into any
contract with said turnpike road company, with the
assent of the said turnpike company, which they
are hereby authorised to give, and upon such terms
as may be agreed upon between the said company
and the company created by this act and not other-
wise, and any contract heretofore entered into by
the said company and Elisha F. Lupton, the said
railroad company are hereby authorised to adopt3
if it shall seem to them expedient, and may enter
upon any land necessary for locating, laying out
or making the said road, branches or extensions,
or any part thereof, over any other route that may
be selected, and may procure land, gravel, earth,
wood or timber for such use, and obtain the rights
and titles to the same, as hereinafter provided.

SEC. 13. And be it enacted, That the president
and directors of the said company may agree with
the owner or owners of any lands, earth, gravel,
timber, or other materials, or any improvements,
for the construction or repair of any of said road or
its works, for the purchase or use and occupation
of the same, and in case they cannot agree, or if
the owner or owners or any of them, be a feme
covert, non compos mentis, or out of the State, on
application to a justice of the peace of Baltimore
county, he shall issue his warrant under his hand
and seal, directed to the sheriff of said county, re-
quiring him to summon a jury of twenty inhabi-
tants of the county, not related nor any wise inter-
ested in the premises, to meet on the land to be
valued on a day to be specified in said warrant, not
