rised to extend a lateral branch of said road, when
opened from the point of divergence aforesaid in or
near the lands of the Baltimore Manual Labor
School, in a southwesterly direction, with and
along the line of the road above alluded to, laid
out from the city of Baltimore to the Sulphur
Spring road, to the termination of said road, and
from said terminus by the most eligible, practica-
ble and convenient route to a point on the Balti-
more and Ohio Railroad, to be designated by said
company, at or near the Relay House station, on
said railroad, and that said lateral branch road
shall be of the same width as the main road, and
constructed in the same manner, and in every re-
spect subject to the same provisions, limitations
and conditions of this act, and be regarded as a
component part and parcel of said road.

SEC. 10. And be it enacted, That the president
and directors of said company be and they are
hereby authorised and empowered to survey and
locate, or cause to be surveyed or located by any
competent surveyor, the road aforesaid, as nearly
in the neighborhood of the route above specified as
may be found most eligible and practicable, at any
time after the organization of said company, and
agree with the owners of said lands for the pur-
chase and occupation of the land required for said
road, and also for the purchase of stone, gravel,
earth or timber required in the construction thereof;

be summoned

and in all cases where they are unable to agree
with said owner or owners, or where he or they
shall be a feme covert, infant, or non compos mentis,
the said president, upon giving notice in writing,
of not less than twenty days, to the parties inter-
ested, may apply to a justice of the peace of Balti-
more county, who shall thereupon issue his war-
rant to the sheriff of said county, commanding
him to summon twenty disinterested persons, quali-
fied to act as jurors in the Circuit court of Balti-
more county, to meet upon the land, and after four
of the jurors so summoned are stricken off the
panel by the president of said company, or his
agent, and four others by the person or persons in-
terested in said land, or his or her agent, or in the
absence or a refusal to strike off by such persons or
their agents, four to be stricken off by the said
sheriff, the sheriff shall qualify the twelve remain-
ing jurors, either by oath or affirmation, as the
