CHAPTER 31
(Senate Bill 74)

AN ACT permitting the Board of County Commissioners and
the Board of Election Supervisors of Harford County to
waive the use of voting machines in elections prior to June
1, 1951.

WHEREAS, by Chapter 734 of the Acts of the General As-
sembly of Maryland of 1949, Section 85 of Article 33 of the
Annotated Code of Maryland (1947 Supplement) was re-
pealed and re-enacted, so as to make mandatory the use of
voting machines in Harford County in all elections held after
June 1st, 1949; and

WHEREAS, the Board of Supervisors of Elections for Har-
ford County, with the approval of the Board of County Com-
missioners of Harford County did enter into a contract on
October 4th, 1949, for the purchase of voting machines for
use in said County; and

WHEREAS, litigation has arisen as a result of such contract
which litigation creates an emergency situation in that the
litigation may not be terminated in time to procure voting
machines for the 1950 elections, and in the interim the sev-
eral Boards are under a contract to purchase voting ma-
chines; now therefore

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That if any contract for the purchase of voting ma-
chines for Harford County, entered into prior to the date of
the enactment thereof, is declared to be illegal by a court of
competent jurisdiction; or if pending litigation with respect
to any such contract makes it impossible, in the judgment
of the Board of Supervisors of Elections for Harford County
to acquire voting machines which conform in all particulars
with the specifications of Article 33, Section 87 of the Anno-
tated Code of Maryland (1947 Supplement), in time for use
at any election prior to June 1st, 1951, then by resolution
passed by both of such Boards, prior to such election, the use
of voting machines, notwithstanding the provisions of Chapter
734 of the Acts of 1949 may be waived and suspended as to
any election held in Harford County, prior to June 1st, 1951.
