existence in any judicial proceeding. All powers, privileges,
restrictions, duties and discretions vested in or imposed upon
the County Commissioners with respect to the adoption of
any rules or regulations hereunder shall apply with equal
force and effect to the change, repeal or amendment of any or
all of said rules and regulations, in whole or in part.
The said County Commissioners, in addition to any remedies
and penalties otherwise prescribed by law, shall have the
right to enforce said rules and regulations and the Fire Pre-
vention Code adopted under the authority of this Act and
prevent infractions thereof by an application in the name of
the Chief of the Fire Prevention Bureau to the Circuit Court
for Baltimore County in Equity for an injunction and a breach
or threatened breach or violation of any provision of the Fire
Prevention Code of Baltimore County or of said rules and
regulations shall constitute sufficient cause in itself for the
issuance of such injunction when applied for and no further
cause need be given.
Every person shall fully comply with all the terms and pro-
visions of the Fire Prevention Code hereby authorized. Any
act or actions which are contrary to any provisions or re-
quirement of and any and all failures to comply with any
provision or requirement of said Fire Prevention Code shall
constitute a violation of said Fire Prevention Code. Every
person who commits a violation of said Fire Prevention Code
shall be guilty of a misdemeanor and upon conviction thereof
in any court of competent jurisdiction shall be fined not less
than Ten Dollars ($10.00) nor more than Five Hundred Dol-
lars (|500.00) or be imprisoned in jail for not less than ten
(10) days nor more than three (3) months, or both, in the
discretion of the court, but no conviction hereunder shall in
any manner relieve any person of any other penalties hereunder
nor from the necessity of compliance with all applicable rules,
regulations and laws. Every such person shall be deemed to
be guilty of a separate offense, for each and every day, or any
part thereof, that any such violation continues.
SEC. 2. And be it further enacted, That Sections 248 and
249 of the Code of Public Local Laws of Maryland (1930
Edition), title "Baltimore County", sub-title "Fire Depart-
ment", be and the same are hereby repealed.
SEC. 3. And be it further enacted, That if any provision of
this Act or the application thereof to any person or circum-
stances is held invalid, the remainder of this Act and the
application of such provisions to other persons and circum-
stances shall not be affected thereby. If any provision, clause,
sentence or section of this Act shall be declared to be invalid
or in violation of the State or Federal constitution, the re-
mainder of said Act shall stand and be effective notwith-
standing.
