36. PENALTIES. Any person convicted before any Justice
of the Peace of this State, or Court of Justice, for violating
any of the provisions of Sections 20 to 35, inclusive, unless a
different penalty is otherwise provided in the Section, shall
be guilty of a misdemeanor and upon conviction before any
Justice of the Peace or Court of the county or city where the
offense was committed shall be fined not less than Ten Dollars
($10. 00) nor more than Twenty-five Dollars ($25. 00) and costs
for each and every offense. And in addition to said fine shall
be fined Five Dollars ($5. 00) for each and every game bird and
game animal caught or killed illegally, purchased or offered
for purchase, sold or offered for sale, barter, or exchange, or
taken or killed in excess of the bag limit or found in posses-
sion illegally.
WATER FOWL AND MIGRATORY BIRDS.
37. It shall be unlawful to hunt or take in any manner or
by any means whatever the nest or eggs of any migratory
birds except in the manner and by the means described by
regulations duly adopted by the Secretary of the Interior of
the United States and approved by the President of the United
States by virtue of the authority conferred by the provisions
of the Migratory Bird Treaty Act approved July 3, 1918, and
no person shall take, collect, or possess any nest or egg of
migratory birds except for scientific purposes and must also
obtain a permit from the Game Warden of this State.
38. OPEN SEASON. It shall be unlawful to hunt any wild
waterfowl within the limits of the State of Maryland between
the first day of February and the thirty-first day of October
in each and every year, both dates inclusive, and it shall be
further unlawful to have in possession any dead wild water
fowl between the tenth day of February and the thirty-first
day of October in each and every year, and it shall be unlaw-
ful to hunt any of the game birds herein mentioned on Sunday.
And be it further provided that it shall be unlawful to hunt
wild water fowl at any time or in any manner on either the
land or the waters within the boundary lines of the Black-
water Migratory Bird Refuge located in Dorchester County
or to hunt wild water fowl on either land or water from a
blind or otherwise within 100 yards of the boundary lines of
said refuge.
39. Wild water fowl may be taken during the open season
with a gun only not larger than number ten gauge loaded with
shot only, fired from the, shoulder, from the land and water with
the aid of dog or dogs and the use of decoys and shall not be
taken with or by means of any automatic-loading or hand-oper-
