CHAPTER 636.
(House Bill 708)
AN ACT to add a new section to Article 88B of the Annotated
Code of Maryland (1939 Edition), title "State Police", said
new section to be known as Section ISA, to follow imme-
diately after Section 18 of said Article and to provide for
the disposition of any and all personal property in the cus-
tody of the Department of Maryland State Police remaining
unclaimed for a period of one year after the same came into
such custody; and to repeal and re-enact, with amendments,
Section 31 of said Article, as the same was repealed and re-
enacted by Chapter 822! of the Acts of 1941, relating to the
Pension Fund of said Department.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That a new section be and the same is hereby added to
Article 88B of the Annotated Code of Maryland (1939 Edi-
tion), title "State Police", said new section to follow immedi-
ately after Section 18 of said Article, to be known as Section
ISA and to read as follows:
18A. Whenever any personal property of any kind, except
money, comes into the custody of the Department of Maryland
State Police and the association, person, firm or corporation
entitled to possession of the same cannot be located and fails
to claim the same for a period of one year after it came into
custody of said Department, the Superintendent thereof shall
be authorized and empowered to dispose of the same at public
sale at some place which shall be convenient and accessible
to the public at any time between the hours of 10: 00 A. M. and
6: 00 P. M. on any day of the week except Saturdays and Sun-
days, provided that the time, place and. terms of said sale,
together with a full description of said personal property, shall
be inserted in one or more daily newspapers published in
Baltimore City at least once each week for two successive
weeks prior to said sale. The Superintendent shall in his dis-
cretion fix the terms of said sale and shall be authorized to
employ an auctioneer to make the same. If said personal
property be of the kind for which a certificate of title or regis-
tration shall or should have been issued by any Commissioner,
Commission or Department, whether State or Federal, the
Superintendent shall cause notice by registered mail to be sent
at least ten days prior to said sale to the owner and lien
holder, if any, shown on the records of such Commissioner,
Commission or Department, or to the association, person, firm
or corporation entitled to the possession thereof, if his or its
