CHAPTER 70.
(House Bill 205)
AN ACT to repeal and re-enact, with amendments, Sub-section
(Montgomery County) of Section 100 of Article 52 of the
Annotated Code of Maryland (1939 Edition), as the same
was amended by Chapter 755 of the Laws of Maryland of
1941, title "Justices of the Peace", sub-title "Trial Magis-
trates System", relating to the number and salaries of Trial
Magistrates in Montgomery County, and relating to the ap-
pointment of Clerks and additional deputy sheriffs and to
their duties and compensation.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Sub-section (Montgomery County), of Section 100
of Article 52 of the Annotated Code of Maryland (1939 Edi-
tion), as the same was amended by Chapter 755 of the Laws
of Maryland of 1941, title "Justices of the Peace", sub-title
"Trial Magistrates System", be and it is hereby repealed and
re-enacted, with amendments, to read as follows:
100. (Montgomery County. ) There shall be three trial
magistrates each of whom shall receive an annual salary of
$2, 700. 00 from and after June 1st, 1941. One of said magis-
trates shall sit at Rockville and one at Silver Spring and one
at Bethesda. The magistrate at Silver Spring shall sit not
less than one day or part thereof in each week in Takoma
Park. The Sheriff of Montgomery County, Chief Deputy, and
all other deputies are hereby authorized, directed and re-
quired to serve all civil process issued by said magistrates.
There shall be appointed biennially by each of said trial
magistrates a Clerk for his Court who shall keep all dockets
of and supervise and manage the office of said magistrate and
said Clerk shall perform such other duties as shall be properly
assigned to him by the said Trial Magistrate and he shall re-
ceive an annual salary of fifteen hundred dollars ($1, 500. 00)
payable by the County Commissioners of the said County in
equal monthly instalments; the said Clerks before entering
upon their duties shall each give bond to the State of Maryland
in the penalty of five thousand dollars ($5, 000. 00) with corpo-
