sub-title "Pensions", said new section to be known as Sec-
tion 31A, to follow immediately after Section 31 of said Ar-
ticle and to provide for the transfer, under certain conditions,
of all civilian employees of the Department of Maryland
State Police and all license examiners of the Commissioner
of Motor Vehicles, who became employees of the Department
or of the Commissioner after October 1, 1941, and before
June 1, 1943, from the Pension Fund of said Department
to the Employees' Retirement System of the State of Mary-
land, established by Chapter 377 of the Acts of 1941, to per-
mit the transfer, under certain conditions, of all civilian
employees of said Department and all license examiners of
said Commissioner, who became employees of said Depart-
ment or of said Commissioner on or before October 1? 1941,
from said Pension Fund to said Employees' Retirement Sys-
tem and to provide that all civilian employees of said Depart-
ment and all license examiners of said Commissioner, who
became employees of said Department or of said Commis-
sioner on or after June 1, 1943 shall not be eligible to become
members of said Pension Fund but shall be subject to the
provisions of Article 73B of said Code, as amended from
time to time; and to repeal with certain reservations Section
6 of said Article 88B.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That a new section be, and the same is hereby, added
to Article 88B of the Annotated Code of Maryland (1939 Edi-
tion), title "State Police", sub-title "Pensions", said new sec-
tion to be known a, s Section 31A, to follow immediately after
Section 31 of said Article and to read as follows:
31A. Any provision of law and particularly the provisions
of Sub-section (3) of Section 1 and of Section 3 of Article
73B of the Annotated Code of Maryland (1939 Edition), as
amended, to the contrary notwithstanding,
(1) All civilian employees of the Department of Maryland
State Police and all license examiners of the Commissioner of
Motor Vehicles, who became employees of said Department or
of said Commissioner after October 1, 1941, and before June
1, 1943, shall, as of the latter date, be removed from the Pension
Fund of said Department and within 60 days thereafter the
Superintendent of State Police shall, out of the moneys held
by him in said Pension Fund, pay to each of the employees and
license examiners so removed the total amount of contributions
theretofore made by him to said Fund, without interest;
(2) Any civilian employee of said Department and any
license examiner of said Commissioner, who became an em-
