CHAPTER 290.
(Senate Bill 76)

AN ACT to add a new section to Article 16 of the Annotated
Code of the Public General Laws of Maryland (1939 Edi-
tion), title "Chancery", sub-title "Trustee", said new sec-
tion to be known as Section 270A and to follow immedi-
ately after Section 270 of said Article; such new section
relating to the suspension of the duties of fiduciaries en-
gaged in war or related services, the appointment of their
substitutes or successors, arid their compensation.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That a new section, to be known as Section 270A and
to follow immediately after Section 270 of Article 16 of the
Code of Public General Laws of Maryland (1939 Edition),
title "Chancery", sub-title "Trustee", be and the same is here-
by added to said Article 16, to read as follows:

270A. Fiduciaries in War Service:

(a) For the purposes of this section,. the term fiduciary
shall include a trustee named in or acting under a deed, will,
declaration of trust or other instrument in the nature of a
trust, a consultant whose consent must. be obtained under the
terms of the trust to any action taken by a fiduciary of the
trust, and any trustee, receiver, collector, conservator, commit-
tee or guardian appointed by a court of equity, whether the
trust be created or the appointment be made prior or subse-
quent to the passage of the Act enacting this section.

(b) For the purpose of this section, a fiduciary shall be
deemed to be engaged in war service.

(1) If he is a member of, or detailed for duty with, the
military, naval or other armed forces of the United States or
of any allied or associated power, or if he has been accepted
for such service and is awaiting induction into such service; or

(2) If he is engaged in any work in connection with a gov-
ernmental agency of the United States or in connection with
the American Red Cross Society or any other similar organi-
zation, making it temporarily impractical for him to efficiently
perform the duties of the trust, whether or not he be so en-
gaged within or without the continental United States; or

(3) If when last heard from he was reported to be in any
country or obliged to remain in any other foreign country or
in any possession or dependency of the United States.
