76. REFUNDS ON QUARTERLY BASIS.

Upon the surrender of the certificates and registration plates
provided for in Classes A, B, O,. D, E, F, L, M and N, and upon
application made therefor, the original owner shall be en-
titled to refund of the amount paid for such certificates and
registration plates for the unused portion of the registration
year calculated on a quarterly basis with no allowance for
fractional portions of a quarter.

77. DEPARTMENT TO DETERMINE CLASSIFICATION. The De-
partment shall have authority, in disputed cases, to deter-
mine the registration classification in which any motor vehicle
belongs, under any of the provisions of this Article.

78. OPERATORS AND CHAUFFEURS MUST BE LICENSED, (a)
No person except those hereinafter expressly exempted shall
drive any motor vehicle upon a highway in this State un-
less such person has a valid license as an operator or chauffeur
under the provisions of this Article. No person shall operate
a motor vehicle as a chauffeur unless he holds a valid chauf-
feur's license.

(b) Any person holding a valid chauffeur's license hereun-
der need not procure an operator's license.

Violation of this section shall be deemed to be a misde-
meanor and upon conviction shall be punishable by a fine of
Five ($5. 00) dollars to One hundred ($100. 00) dollars, or by
imprisonment not to exceed sixty (60) days or by both such
fine and imprisonment.

79. PERSONS EXEMPT FROM LICENSE, (a) The following
persons are exempt from license. hereunder:

(a) Any employee of the United States Government while*
operating a motor vehicle owned by the United States Govern-
ment and while engaged in official business of the United
States Government;

(b) Any person while driving or operating any road ma-
chine, farm tractor, or implement of husbandry temporarily
operated or moved on a highway of this State;

(e) A non-resident who is at least sixteen (16) years of
age and who has in his immediate possession a valid operator's
license issued to him in his home State or country may oper-
ate a motor vehicle in this State only as an operator;

(d) A non-resident who is at least eighteen (18) years of
age and who is licensed in his home State or country may
operate a motor vehicle in this State either as an operator or
chauffeur except any such person must be licensed as a chauf-
