ceiving the -vehicle shall within twenty-four hours, apply for a
new certificate in his name, surrendering the assignment of
certificate from the previous dealer and the Department shall
issue a new certificate.
Violation of this section shall be deemed to be a misde-
meanor and upon conviction shall be punishable by a fine of
One ($1. 00) dollar to One Hundred ($100. 00) dollars or by
imprisonment not to exceed one (1) year or by both such fine
and imprisonment.
47. RELEASE BY LIEN HOLDER TO OWNER. The Depart-
ment, upon receiving a certificate of title upon which a lien
holder has released his interest, or upon receipt of a certificate
of title accompanied by a legal release from a lien holder, may
cancel the lien on the face of the title or issue a duplicate cer-
tificate of title upon receipt of an application, with fee, as pro-
vided for in sub-section (f) of Section 32.
48. FAILURE TO DELIVER CERTIFICATE A MISDEMEANOR. It
is a misdemeanor for any person wilfully or knowingly to fail
or neglect properly to endorse and deliver a certificate of title
to a transferee or owner lawfully entitled thereto.
49. DISMANTLING OR WRECKING VEHICLE TO RETURN EVI-
DENCE OF REGISTRATION TO THE DEPARTMENT AND SECURE
PERMIT TO DISMANTLE, (a) Any owner dismantling or wreck-
ing any registered vehicle shall immediately forward to the
Department the certificate of title for cancellation.
(b) Any owner who sells a motor vehicle as scrap or to be
dismantled or destroyed shall assign the certificate of title
thereto to the purchaser and said purchaser shall deliver such
certificate so assigned to the Department with an application
for a permit to dismantle such vehicle. The Department shall
thereupon issue to the purchaser a permit to dismantle the
vehicle which shall authorize such person to possess or trans-
port such motor vehicle.
(e) Provided, that if the engine or part of engine bearing
engine number removed from a dismantled vehicle is sold to
be installed in another vehicle for operation upon the high-
ways, the Department shall prescribe the form for transfer to
the purchaser and subsequent application for new title by
the purchaser.
Violation of Sections 48 and 49 shall be deemed to be a
misdemeanor and upon conviction shall be punishable by a fine
of One ($1. 00) dollar to One thousand ($1, 000. ) dollars or by
imprisonment not to exceed one (1) year or by both such fine
and imprisonment.
