573A. Nothing contained in Section 560 of this Article
shall be construed to prohibit or make unlawful the exhibi-
tion of motion pictures in the City of Hagerstown, Wash-
ington County, between the hours of 1 P. M. and 6: 30 P. M. and
after 9 P. M. on the first day of the week, commonly called
"Sunday", whether the same be exhibited with or without a
charge or admission fee; provided, however, that it shall be
unlawful for any person or persons to exhibit motion pictures
in the City of Hagerstown, - Washington County, before 1
o'clock P. M. or between the hours of 6: 30 P. M. and 9 P. M. on
Sundays. The work or employment of any operator, ticket
seller, or other employee, or attendant, in connection with such
exhibition, shall not be unlawful because performed on Sun-
clay, in the City of Hagerstown, Washington County.
573B. Any person, firm or corporation violating any of
the provisions of Section 573A shall be deemed guilty of a
misdemeanor, and upon conviction thereof shall be subject to
a fine of not more than Five Hundred Dollars ($500. 00) for
every such violation.
SEC. 2. And be it further enacted, That this Act shall con-
tinue in effect until the municipal election to be held in the
City of Hagerstown, in March, 1945, at which time this Act
shall be submitted to the legally qualified voters of the City of
Hagerstown for adoption or rejection. There shall be printed
on the ballots to be used at said election, the title of this Act
and underneath said title, on separate lines, a square or box
to the right of and opposite the words "For Motion Pictures
on Sunday in the City of Hagerstown" and a corresponding
square or box to the right of and opposite the words "Against
Motion Pictures on Sunday in the City of Hagerstown", so
that the voters shall be able to designate by a crossmark in the
proper square or box his or her decision for or against said
question. If a majority of the votes cast thereon shall be
"For Motion Pictures on Sunday in the City of Hagerstown",
then this Act shall continue to be in effect, but if a majority
of the votes cast thereon be "Against Motion Pictures on
Sunday in the City of Hagerstown", then this Act shall be null
and void and of no effect on and after April 1, 1945.
• SEC. 3. And be it further enacted, That this Act is hereby
declared to be an emergency law and necessary for the im-
mediate preservation of the public health and safety, and
having been passed by a yea and nay vote, supported by three-
fifths of all the members elected to each of the two Houses of
the General Assembly, the same shall take effect from the date
of its passage.
