ance with the provisions of Section 20 of this Article,
except that in Washington County the fee shall be 40$.
SEC. 2. And be it further enacted, That this Act shall
take effect June 1, 1943.

AN ACT to add a new Section to Article 27 of the Anno-
tated Code of Maryland, title "Crimes and Punishments",
sub-title "Department of Correction", said new Section
to be known as Section 782A, and to follow immediately
after Section 782 of said sub-title, relating to the tem-
porary removal of ill prisoners from State penal institu-
tions in cases where the medical facilities of such institu-
tions for the treatment of such prisoners are inadequate.
SECTION 1. Be it enacted by the General Assembly of Maryland,
That a new Section be and it is hereby added to Article 27
of the Annotated Code of Maryland (1939 Ed. ), title
"Crimes and Punishments", sub-title "Department of Cor-
rection", said new Section to be known as Section 782A,
to follow immediately after Section 782 of said sub-title
and to read as follows:
782A. Whenever it appears to the officer in charge of
any penal institution that a prisoner in such institution is
ill, and that the facilities of the institution are inadequate
to provide treatment for such illness, the said officer may
recommend to the Board of Correction that such prisoner
be temporarily removed to any place within the State where
adequate treatment may be obtained. If the Board of
Correction approves of such recommendation, it is hereby
authorized to direct the temporary removal of such prisoner
for a definite period of time, or from time to time, to a
place where adequate treatment for the illness of such
prisoner may be obtained, with such guards and under such
supervision and safeguard to prevent the escape of such
prisoner from custody, and subject to such rules and regu-
lations with regard to guards, supervision and terms of
temporary release as the Department of Correction may
prescribe, provided that any such order shall direct the
return of such prisoner to the institution in which he was
