to law or is being so conducted as to endanger the public
health or safety.

(d) Any person, co-partnership, association or corpora-
tion, to whom the said Maryland Board of Pharmacy has re-
fused to issue a permit, or whose permit has been revoked
may appeal from the decision and order of said Maryland
Board of Pharmacy to the Circuit Court of the County in
which the pharmacy or proposed pharmacy in question is or
is intended to be located, and if the same is or is intended to
be located in Baltimore City, to the Circuit Court or Circuit
Court No. 2 of Baltimore City, at any time within thirty
(30) days after the date of the receipt by the applicant
of the decision of the said Maryland Board of Pharmacy;
provided, however, that the appellant shall give bond, in
the penalty of $500, to be approved by the Clerk of the
Court in which such appeal shall be filed, conditioned to
pay all costs if the decision and order appealed from
be affirmed, whereupon, the execution of said decision and
order shall be stayed pending such appeal

(e) Any person, co-partnership, association or corpora-
tion, violating any of the provisions of this section, shall,
upon conviction, be deemed guilty of a misdemeanor and
fined not more than one hundred ($100) dollars for each
offense, and each and every day such violation continues
shall constitute a separate and distinct offense.

All permit fees collected under the provisions of this sec-
tion shall be used by the Maryland Board of Pharmacy, so
far as may be necessary, for the enforcement of the pro-
visions of this sub-title.

SEC. 2. And be it further enacted, That this Act shall
take effect June 1, 1943.

(Senate Bill 423)

AN ACT to authorize and empower the Mayor and Town
Council of Oakland, Garrett County, Maryland, to issue
; and sell bonds of said town to an amount not exceeding
Fifty Thousand Dollars ($50, 000. 00) for the purpose
of refunding and retiring the Water and Sewerage
Bonds issued under the provisions of Chapter 277 of the
Acts of 1908, Reservoir Bonds issued under the provi-
sions of Chapter 218 of the Acts of 1935 and Commu-
