thereof shall constitute a misdemeanor punishable by a
fine of not more than one hundred dollars ($100. 00).

FINANCE COMMISSION

38. (1) A Finance Commission for the Town of Bruns-
wick is hereby created. Said commission shall be composed
of (1) the president of each bank located within the cor-
porate limits of Brunswick ex-officio to serve during con-
tinuance as such president, provided, however, if said pres-
ident is not a resident of the town, then the highest rank-
ing official of said bank who is a resident of Brunswick
shall be appointed instead, and (2) one capable and experi-
enced business man of Brunswick appointed by the Mayor
of Brunswick for a term of office concurrent with that of
the Mayor. Members of the Finance Commission shall
serve without compensation.

(2) a. Before the Mayor and Council shall issue any
bonds, impose any taxes, or take action on any other matter
involving the finances of the town, such matter shall be
referred to the Finance Commission for consideration and
recommendation.

b. The Commission shall promptly consider such matter
and report to the Mayor its recommendations thereon which
shall be open to the public. If the Commission so requests,
the Mayor and Council shall hold a public hearing on such
matter before taking action, but otherwise such recommen-
dations shall not be binding on the Mayor and Council.

(3) Any action of the Mayor and Council in violation
of this Section shall be void.

(4) Before any appointments, except the appointed mem-
ber of the Finance Commission, are made by the Mayor;
he shall submit the names of the applicants or nominees
to the Finance Commission who shall determine their qual-
ifications and return said list to the Mayor. No person
shall be appointed to any office unless he is considered quali-
fied by the Finance Commission,, but the Mayor may sub-
mit as many lists of nominees as he may desire to the
Finance Commission.

AUDITOR

39. (1) There shall be a City Auditor.

(a) On or before the 25th day of August in each year
in which the Mayor is elected, the Finance Commission
shall send to the Mayor-elect a list containing the names
