CHAPTER 736.

(Senate Bill 528)

AN ACT to repeal and re-enact, with amendments, Section
172 of the Code of Public Local Laws of Montgomery
County (1939 Edition), being Article 16 of the Code of
Public Local Laws of Maryland (1939 Edition), title
"Montgomery County, " sub-title "County Accountant
and Budget"

SECTION 1. Be it enacted by the General Assembly o j Maryland,
That Section 172 of the Code of Public Local Laws of
Montgomery County (1939 Edition), being Article 16 of
the Code of Public Local Laws of Maryland (1939 Edition),
be, and the same is hereby repealed and re-enacted, with
amendments to read as follows:

172. No appropriation made by the appropriation reso-
lution shall be transferred from one fund to another fund,
except that the Board of County Commissioners may by
resolution duly recorded in its minutes order the transfer
of all or any part of the unencumbered balance of an ap-
propriation, and copies of such resolution shall be fur-
nished to the County Accountant and to the head of each
department to which, or from which, such transfer shall
be made. The Board of County Commissioners are hereby
empowered and authorized, when in their opinion, any
part of an appropriation in one fund can be used more
effectively when combined with money in other funds, to
transfer such money to any other fund in order to more
effectively use said money for the purpose for which the
said money was appropriated.

SEC. 2. And be it further enacted, That all laws or
parts of laws inconsistent with the provisions of this Act
be and they are hereby repealed to the extent of such in-
consistency.

SEC. 3. And be it further enacted, That this Act shall
take effect June 1, 1943.
