surplus carried over from the preceding fiscal year for the
fiscal years ending September 30, 1941, and September 30,
1942, exceed the appropriations for each of said years, as
contained in the State Budget for said years, by more
than Two Million Dollars ($2, 000, 000. 00), the Board of
Public Works, in its discretion, may by a resolution dedi-
cate all or any part of such excess revenues to the pay-
ment of the interest and principal of the State debt payable
during each of the fiscal years ending September 30, 1942
and September 30, 1943. After the adoption of such a reso-
lution, the part of the excess revenues so dedicated shall
be applied exclusively to the payment of such interest and
principal and to no other purpose. Such a resolution
shall operate to reduce the State real estate tax rate for
the fiscal years ending September 30, 1942, and Septem-
ber 30, 1943, by the amount so dedicated to the State debt.
Immediately upon the adoption of such a resolution, the
Governor shall issue a proclamation setting forth the
amount of such reduction in the State tax rate, and the
resulting rate for the fiscal years ending September 30.
1942, and September 30, 1943, respectively. This act shall
not apply to dedicated funds.

SEC. 2. And be it further enacted, That this Act shall
take effect June 1, 1941.

CHAPTER 529.

(Senate Bill 408)

AN ACT to repeal and re-enact, with amendments, Sec-
tion 5 of Article 62 of the Annotated Code of Maryland
(1939 Edition), title "Marriages", relating to the power
of Judges to authorize the Clerk to deliver license for
marriage before expiration of forty-eight (48) hours
after application therefor.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Section, 5 of Article 62 of the Annotated
Code of Maryland (1939 Edition), title "Marriages", be
and it is hereby repealed and re-enacted, with amend-
ments, to read as follows:

5. Before the Clerk of any of the Courts aforesaid
