15. All moneys received as penalties for violations of
the provisions of this Article, less the cost of collection
and not otherwise provided for, together with any moneys
obtained from the State forest reserves, shall be paid into
a special fund in the State Treasury known as the Forest
Reserve Fund; out of said Fund there shall be paid each
year to the County Commissioners of each County in which
shall be located any part of the State forest reserves, fif-
teen per cent, of the revenue derived from such part of
the State forest reserves as is located in that county. The
balance of said fund shall not revert to the General
Treasury, but shall be dedicated to the purposes of forest
protection, management, replacement and other purposes
of the Department.
SEC. 8. And be it further enacted, That the sub-title
"State Geological and Economic Survey" and Sections 19
to 24, inclusive, of Article 91 of the Annotated Code of
Maryland (1939 Edition), the sub-title "Water Front Com-
mission" and Sections 22 to 26, inclusive, of Article 19A
of said Code, be and the same are hereby repealed; and
that a new sub-title to be known as "Department of Geol-
ogy, Mines and Water Resources" and three new Sections,
to be known as Sections 12A, 12B and 12C be added to
Article 19A, immediately after Section 12 of said Article,
to read as follows:
DEPARTMENT OF GEOLOGY, MINES AND
WATER RESOURCES
12A. The Department of Geology, Mines and Water
Resources is hereby created, to supersede the present State
Geological and Economic Survey Advisory Commission,
the Bureau of Mines, the Water Front Commission, and
the Water Resources Commission, and take over all of the
personnel powers and duties exercised by those agencies.
The Department shall be under the direction of a Commis-
sion which shall consist of five members appointed by the
Governor from among the citizens of the State with char-
acter, ability and active interest in the proper development,
use and conservation of such resources. The members shall
select their own Chairman. Their term of office shall be
five years from June 1, 1941, but of those first appointed,
one shall serve for one year, one for two years, one for
three years, one for four years, and one for five years.
The Governor may remove any member for cause, and any
vacancy shall be filled for the unexpired term. The mem-
bers shall receive no compensation for their services, but
shall be reimbursed for necessary travelling expenses and
