SEC. 2. And be it further enacted, That if any section, sen-
tence, subdivision or clause of this Act is for any reason held
invalid or to be unconstitutional, such decision shall not affect
the validity of the remaining portions of this Act.
SEC. 3. And be it further enacted, That this Act shall take
effect June 1, 1941.

CHAPTER 436.
(House Bill 328)
AN ACT to repeal and re-enact, with amendments, Section 58
of Article 39 of the Code of Public General Laws of Mary-
land (1939 Edition), title "Fish and Fisheries", sub-title
"Sizes of Commercial Fish", said amendments prescribing
different sizes and weights of certain fish to be taken under
the provisions of said section and adding three additional
types of fish thereto and prescribing1 the size thereof.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 58 of Article 39 of the Code of Public
General Laws of Maryland (1939 Edition), title "Fish and
Fisheries", sub-title "Sizes of Commercial Fish", be repealed
and re-enacted, with amendments, to read as follows:
58. No person shall catch or in any manner take or kill,
sell, offer to buy or sell or expose for sale, or have in possession
any bass, large or small mouth, less than 10 inches; any cat-
fish less than 7 inches; any perch, white or yellow, less than
7 inches; any pike less than 14 inches; any rock, otherwise
known as striped bass, less than 11 inches in length or weigh-
ing more than 15 pounds, it shall be lawful, however, in the
Susquehanna River above Hog Back Shoals to catch striped
bass weighing more than fifteen (15) pounds, provided said
striped bass so taken are caught only with a hook and line
and not sold or offered for sale; any sturgeon weighting less
than 25 pounds; any taylor or bluefish less than 8 inches; any
sea trout or weakfish less than 8 inches; any hardheads or
croakers less than 7 inches; any butterfish less than 6 inches;
measurement in the case of each fish shall be from the tip of
the nose to the end of the caudal fin or tail.
SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1941.
