two houses of the General Assembly, the same shall take
effect from the date of its passage.

CHAPTER 389.
(Senate Bill 145)

AN ACT to repeal Sections 159, 160, 161, 162, 163, 164, 168
and 169 of Article 72 of the Annotated Code of Mary-
land (1939 Edition), title "Oysters", sub-title "Reserved
Areas", and to enact in lieu thereof eight new sections to
be known as Sections 159, 160, 161, 162, 163, 164, 168
and 169 of said Article; authorizing the Conservation
Commission to reserve certain areas in the Chesapeake
Bay and tributaries for oyster conservation or propaga-
tion, specifying the powers of the Commission in connec-
tion therewith, levying a special tax on oysters caught
on planted areas, and providing penalties for violation of
this Act and prescribing the salary of the Commander
of the Fishery Force.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Sections 159, 160, 161, 162, 163, 164, 168,
169 of Article 72 of the Annotated Code of Maryland (1939
Edition), title "Oysters", sub-title "Reserved Areas", be
and the same is hereby repealed and eight new sections in
lieu thereof be enacted and to be known as Sections 159,
160, 161, 162, 163, 164, 168 and 169 and to read as follows:

159. The Conservation Commission is authorized to
close to dredging and reserve any portion of the natural
beds, bars or rocks of the Chesapeake Bay or tributaries
in dredger's area, whenever in the judgment of the Com-
mission such reservation is necessary or advisable to pro-
tect or promote the growth of oysters thereon by a period
of rest or by planting thereon oysters, shells or other
cultch, or in any other feasible manner which the Commis-
sion may deem best. The Commission shall give notice of
such reservation by advertisement to be inserted in at least
one newspaper of general circulation in the State and by
notice to the Commander of the Fishery Force and the Dep-
uty Commanders in charge of the reserved area or areas;
said notice shall describe the area reserved and give the
date on which the reservation takes effect, which date shall
