the Board of County Commissioners of Montgomery County
to construct the said Kensington Parkway, in the event that
the State Roads Commission shall, for any reason, refuse to
construct the same; to provide generally for the payment of
interest on the said bonds and the principal thereof by the
levy of taxes upon the Maryland-Washington Metropolitan
District in Montgomery County or if such is insufficient
upon the whole of Montgomery County for the deficiency,
and to provide that this Act shall be passed as an emer-
gency measure", providing for the levying of taxes upon all
of the assessable property in Montgomery County to pay
the interest on and to redeem the said bonds.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 5 of Chapter 133 of the Acts of 1939, en-
titled "An Act to authorize and empower the Board of County
Commissioners of Montgomery County in its discretion to
borrow upon the faith and credit of said county to the amount
of Seventy-five Thousand Dollars ($75, 000. 00), and to issue
and sell bonds therefor, the proceeds thereof to be used by the
Board of County Commissioners of Montgomery County to pay
the State Roads Commission of Maryland for the construction
of Kensington Parkway, within the Maryland-Washington
Metropolitan District in Montgomery County, to authorize
the Board of County Commissioners of Montgomery County to
construct the said Kensington Parkway, in the event that the
State Roads Commission shall, for any reason, refuse to con-
struct the same; to provide generally for the payment of
interest on the said bonds and the principal thereof by the
levy of taxes upon the Maryland-Washington Metropolitan
District in Montgomery County or if such is insufficient, upon
the whole of Montgomery County for the deficiency, and to
provide that this Act shall be passed as an emergency meas-
ure", be and it is hereby repealed and re-enacted, with amend-
ments, to read as follows:
5. For the purpose of paying the interest on said bonds,
and for redeeming the said bonds as they mature, the said
Board of County Commissioners of Montgomery County
are here authorized and directed to levy annually until all
of said bonds issued under the authority of this Act shall
mature and be redeemed, a tax upon the assessable property
in Montgomery County sufficient to pay the annual interest
on said bonds outstanding, and to redeem said bonds as they
mature and become due, said taxes to be collected as other
taxes levied in said county are collected.
SEC. 2. And be it further enacted, That this Act shall be
declared to be an emergency law and necessary for the imme-
