subject the same hereafter to such franchise tax and regula-
tions as they may by Ordinance prescribe; they shall
also have power to provide for the codification of all
ordinances which may have been or may hereafter be
passed; and for the purpose of carrying out the foregoing
powers, and the preservation of cleanliness, health, peace and
good order of the community, and the protection of the lives
and property of the citizens to insure the observance of or-
dinances by fines and penalties or both not exceeding One
Hundred ($100. 00) Dollars or six months imprisonment in the
County Jail, in any case as to them appears right; and in de-
fault of the payment of any fine imposed, they may provide for
the imprisonment of the offender for a period not exceeding
twenty days or until the fine be paid; and instead of the afore-
said penalties, it shall be lawful in the case of conviction of
any person for vagrancy to sentence such person to hard work
for a period not exceeding ten days; they shall have power and
authority to construct wharves at the end of such streets as
extend into the river, and to determine upon and regulate all
matters relating to the erecting or building of said wharves;
to regulate the moving of rafts, arks, boats and floats anchored
in front of said City to the obstruction of navigation or the
health of the citizens; to prevent the depositing of garbage and
filth in the "Deep Cut" or "Old Cut" between the dual lanes
of St. Clair Street and to compel the Philadelphia, Wilmington
and Baltimore Railroad Company or the Pennsylvania Rail-
road or its successors to keep the same clean and to construct
and maintain sufficient, adequate and safe bridges over the
"Old Cut" of the same width as the streets thereover from
curb to curb, in addition to sidewalks of the same width as
other sidewalks thereover and to enforce these provisions
through Ordinances with penalties for violation of the same.

TAX LEVY, FLOATING DEBTS AND BONDED INDEBTEDNESS.

SEC. 48. A tax levy must be made on the second Monday of
September in each year for the fiscal or calendar year to follow
and must be predicated on estimates determined sufficient to
meet the running expenses of the City, to pay interest or debts
and outstanding obligations, to produce adequate sums for a
Sinking Fund, to retire any bonds that may mature and pro-
vide for adequate improvements during that period.

SEC. 49. The Mayor and City Council may create or con-
tract a floating debt during any calendar year not to exceed a
total of Five Thousand ($5, 000. 00) Dollars but the total out-
standing floating debt, including that now existing, shall at
110 time exceed Twenty Thousand ($20, 000. 00) Dollars unless
the consent of a majority of the legal voters cast at a general
