CHAPTER 899.
(House Bill 117)

AN ACT to add eleven new Sections to Article 48A of the
Annotated Code of Maryland (1939 Edition), title "Insur-
ance", said new sections to be placed under a new sub-title
"Explosives", and to be known as Sections 244 to 254,
inclusive, and to follow immediately after Section 243 of
said Article, providing for the licensing by the Insurance
Commissioner of the manufacture and sale of explosives, '
and for the licensing by the Clerks of the Circuit Courts
in the Counties and by the Clerk of the Court of Common
Pleas of Baltimore City, of the possession of explosives.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That eleven new sections be and they are hereby added
to Article 48A of the Annotated Code of Maryland (1939
Edition), title "Insurance", under a new sub-title "Explo-
sives", said new sections to be known as Sections 244 to 254,
inclusive, to follow immediately after Section 243 of said
Article and to read as follows:

244. Definitions. As used in this Act:

(a) "Explosives" means gunpowders, powders used for
blasting, high explosives, blasting materials, fuses (other than
electric circuit breakers), detonators and other detonating
agents, smokeless powder and any chemical compound or any
mechanical mixture containing any oxidising and combustible
units, or other ingredients in such proportions, quantities, or
packing that ignition by fire, friction, concussion, percussion
or detonation of any part thereof may and is intended to cause
an explosion, but shall not include fixed ammunition for small
arms, firecrackers or matches.

(b) "Person" includes any natural person, partnership, as-
sociation or corporation.

(c) "Manufacturer" means any person who is engaged in
the manufacture of explosives or who otherwise produces any
explosive.

(d) "Dealer" means any person, not a manufacturer, en-
gaged in the business of buying and selling explosives.

(e) "Commissioner" means the Insurance Commissioner of
the State of Maryland.

(f) "Local licensing authority7' shall mean the Clerk of
the Circuit Court except as to Baltimore City where it shall
mean the Clerk of the Court of Common Pleas.
