CHAPTER 838.
(House Bill 165)

AN ACT to add a new section to Article 2 of the Code of
Public Local Laws of Maryland (1930 Edition), title "Anne
Arundel County", sub-title "Roads", said new section to be
known as Section 416B and to follow immediately after
Section 416A of said Article, relating to the taking over,
improving or maintaining of roads by the County Commis-
sioners of Anne Arundel County.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That a new section be and it is hereby added to Article 2
of the Code of Public Local Laws of Maryland (1930 Edition),
title "Anne Arundel County", sub-title "Roads", said new sec-
tion to be known as Section 416B, to follow immediately after
Section 416A of said Article, and to read as follows:

416B. The County Commissioners of Anne Arundel County
shall not take title to, take over, improve, or maintain any
road unless and until

(a) The road has been constructed, including establishment
of grades, grading, draining and surfacing in accordance with
plans prepared by the County Road Engineer or the State
Roads Commission and approved by the County Commission-
ers; or

(b) The road taxes collected for the three (3) previous
fiscal years on properties abutting on the road amount in the
aggregate to fifty percent (50%) of the cost of establishing
grades, grading, draining and surfacing the road.

"Road" includes any road, highway, street or alley, not a
part of the County road system.

SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1941.
