date or candidates for Councilman, if he so desires, which
name or names may not already be printed on the ballot, and
three days prior to the holding of such election the Mayor
shall appoint three qualified voters of the town of Hurlock to
act as Judges, and every person so appointed before an elec-
tion is opened shall appear before a Justice of the Peace or
Notary Public for Dorchester County, and take oath "that he
will faithfully and impartially permit every person to vote at
such election who shall be duly qualified, and that he will not
suffer any person to vote at such election who shall not be
legally qualified to vote", and in case of failure of any of said
person or persons so appointed to appear and qualify the
Mayor shall issue a certificate to one or more persons to act
as such Judge or Judges, who shall qualify as above, and they
shall immediately after the election return to the Clerk of
Hurlock under their hands the numbers of votes cast and for
whom cast, who shall file the same at once and issue certifi-
cates of election to the person or persons receiving the largest
number of votes for the respective offices, provided, that for
the first election held under this amended Charter the present
Commissioners of Hurlock shall conduct the same in accord-
ance with the provisions of this Act.
5. That in the event that there shall be a failure to make
any nomination for any one or more of the offices to be
elected hereunder, then it shall be lawful to nominate by filing
a written statement of candidacy and nominating petition as
aforesaid, a candidate or candidates, as the case may be, for
such office or offices at any time prior to the holding of said
election.
6. That, if any election for Mayor or Councilmen there
shall be a tie vote between any candidate or candidates for the
same office, a special election shall be called by the Mayor
and Council and shall be conducted in the same manner as is
provided for in Section 4 of this Act.
7. That if any vacancy shall occur in the office of Mayor
or Council by death, removal, resignation, failure to qualify
or otherwise, those remaining of the Mayor and Council of
Hurlock at their next regular meeting or within 30 days shall
elect a suitable person as Mayor or Councilman as the case
may be to serve until the next election who shall subscribe to
the oath which shall be certified to and recorded as is pro-
vided in Section 8, and if at any time it shall occur that there
is 110 Mayor or Councilman of Hurlock in office, any five
qualified voters residing in said City of Hurlock may in writ-
ing call upon any Justice of the Peace in the town of Hurlock
or of Dorchester County to hold an election as in the case of
