CHAPTER 715.

AN ACT to add a new section to the Code of Public Local
Laws of Montgomery County (1939 Edition), being Article
16 of the Code of Public Local Laws of Maryland, title
"Montgomery County", sub-title "County Commissioners
and Treasurer", to be under new sub-heading "Refuse Col-
lection", said new section to be known as Section 214A and
to follow immediately after Section 214 of said Code, relat-
ing to refuse collection in Montgomery County.
SECTION 1. Be it enacted by the General Assembly o\f Mary-
land, That a new section be and it is hereby added to the Code
of Public Local Laws of Montgomery County (1939 Edition),
being Article 16 of the Code of Public Local Laws of Mary-
land, title "Montgomery County", sub-title "County Commis-
sioners and Treasurer", to be under new sub-heading "Refuse
Collection", said new section to be known as Section 214A, and
to follow immediately after Section 214 of said Code, and to
read as follows:
REFUSE COLLECTION.
214A. (a) The County Commissioners of Montgomery
County may—
(1) regulate and control the collection of refuse in any
part of the County;
(2) establish and maintain such service and disposal
plants as they deem necessary or desirable for the collection
and disposal of refuse, and fix the charges for such service;
(3) license or contract with a contractor to collect and
dispose of such refuse under such regulations as to charges
and methods as they deem advisable;
(4) contract for the construction or operation or both of
incinerators or other disposal plants, to be paid for from
charges or otherwise, and to become the property of the
County after such period and upon such terms as they may
prescribe.
(b) While the Board of County Commissioners or any other
board or agency is providing refuse collection service in any
area of the county, all authority of any other board or agency
shall be suspended as to that area.
(c) "Refuse" includes garbage, ashes, trash and other waste
or refuse.
SEC. 2. And be it further enacted, That nothing contained
in this Act shall be construed, interpreted, or adjudicated to
