1240 LAWS OF MARYLAND. [CH. 711

known as Sections 1029 to 1029-1, inclusive, and to read as
follows:

1029. The term "issuing authority" shall mean the Health
Officer of Montgomery County or the County Building In-
spector or the authorized representative of either. The term
"excreta disposal plant" shall mean a cesspool, septic tank,
privy or other plant or device of any kind whatsoever for
the disposal of human excreta (but not including a sewer pipe
connected to an approved public sewer) for any dwelling,
apartment house, store, or other building occupied or to be
occupied either for dwelling or for business purposes. The
term "excreta disposal plant" shall also include the property
itself whenever no adequate excreta disposal facilities exist,

1029A. The Board of Health of Montgomery County shall
from time to time adopt rules, regulations and specifications
for the construction, reconstruction, and maintenance of
excreta disposal plants. The Board of Health of Montgomery
County may impose reasonable and uniform fees for the issu-
ance of excreta disposal permits to cover the cost of inspection,

1029B. No person, firm or corporation shall begin construc-
tion of any dwelling, apartment house, store or other build-
ing to be occupied either for dwelling or for business pur-
poses and located beyond reach of the public sewer without
first obtaining a permit for the excreta disposal plant from
the issuing authority.

1029C. (a) No person, firm or corporation shall construct,
enlarge or reconstruct any excreta disposal plant without
first obtaining from the issuing authority an excreta disposal
permit.

(b) Applications for the aforesaid excreta disposal per-
mits shall be made on forms prescribed by the Board of
Health and shall be accompanied by acceptable plans and
specifications and any inspection fee imposed by the County
Board of Health.

1029D. The issuing authority shall review plans and speci-
fications submitted for the aforesaid excreta disposal plants
and issue permits when these plans and specifications comply
with the rules, regulations and specifications adopted by the
County Board of Health; and the issuing authority shall make
inspections of said plants during construction.

1029E. Construction of excreta disposal plants shall be in
accordance with the rules, regulations and specifications of
