"Salisbury", as amended by Chapter 105 of the Acts of 1933
(Special Session), providing for the bond of the Clerk,
Collector of City Taxes and Treasurer.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 280 of Article 23 of the Code of Public
Local Laws of Maryland (1930 Edition), title "Wicomico
County", sub-title "Salisbury", as amended by Chapter 105 of
the Acts of 1933 (Special Session), be and it is hereby repealed
and re-enacted, with amendments, to read as follows:
280. The said Clerk to the Council, Collector of City Taxes
and Treasurer, before entering upon the performance of the
duties of his office, shall take and subscribe to an oath before
a justice of the peace residing in said city that he will well
and faithfully perform the duties of his said office according to
law and the ordinances of said city, which oath is to be re-
turned to the Council and recorded as provided for the oaths
of other officers, which oath, record of same or a copy thereof
are hereby made evidence in any court of this State. He shall
give bond to the State of Maryland in the penalty of Fifty
Thousand Dollars with a fidelity or surety company, qualified
to act as surety or guaranty under the laws of the State of
Maryland, as surety, conditioned that he will well and faith-
fully perform the duties of clerk, treasurer and collector of
taxes in all things, according to law and the ordinances of the
city, and that he will account for and pay over all moneys that
may come into his hands as clerk, collector or treasurer in the
manner and as required by law and said ordinances, provided
that he and his surety shall not be responsible for any losses
incurred through the failure or insolvency of any depository
selected and approved by ordinance or resolution of the Mayor
and Council of Salisbury and in which he shall have duly de-
posited any funds coming into his hands by virtue of his office,
and provided, further, that the surety or sureties on Ms bond
shall not be liable for any loss or losses resulting by reason of
the failure of said clerk, treasurer and collector to collect any
portion or all taxes which may be chargeable to collect by
reason of his appointment as said clerk, treasurer and col-
lector. Said bond shall be paid for by the Mayor and Council.
The said bond shall be approved by the Council and spread
upon its minutes, and then delivered with the approval en-
dorsed thereon to the Clerk of the Circuit Court for Wicomico
County for record, a certified copy of the same from either
record to be in evidence in any court of this State. If the
person so elected shall fail or neglect to give satisfactory bond
on or before the first day of his term of office, the Mayor
shall appoint some other person to said office, to be confirmed
