SECTION 1. Be It enacted by the General Assembly of Mary-
land, That Section 123 of Article 11 of the Code of Public Lo-
cal Laws of Maryland (1930 Edition), title "Frederick Coun-
ty", sub-title "Roads", as said section was amended by Chap-
ter 695 of the Acts of 1939, be and it is hereby repealed and
re-enacted, with amendments, to read as follows:
123. A County Roads Board for Frederick County is here-
by created. The Board shall consist of eight (8) members,
five of whom shall serve without salary for a term beginning
May 1st, 1939, and which shall be constituted as follows: Wil-
liam E. Hauver for a term of two years, James D. Adams for
a term of three years, Roy M. Fisher for a term of four years,
Fred W. Springer for a term of five years, William Hobbs for
a term of six years, the remaining three members shall be the
County Commissioners. At the expiration of the term of office
of the five members appointed in this Bill, their successors
shall be appointed for a term of five years as hereinafter pro-
vided. Not less than thirty (30) days prior to the expira-
tion of the term of office of any member of said Board and
within ten (10) days after the death or resignation of any
member of said Board, the said County Roads Board of Fred-
erick County shall submit the names of three (3) persons to
the Governor and he shall appoint one of said persons for a
term of five (5) years or to fill said vacancy as the case may
be. If the Governor shall refuse or fail to make such appoint-
ment within five days, then the said County Roads Board
shall proceed to make said appointment. The Board shall
hold one regular meeting per month for which each appointed
member shall be paid the sum of Five Dollars ($5. 00) for ac-
tual attendance at said meeting, and provided further that
upon the vote of five of the members of said Board, a special
meeting or special meetings may be called for which the mem-
bers of said Board shall receive traveling expenses at the rate
of five cents (5c. ) per mile and no other remuneration f or said
attendance.
SEC. 2. And be it further enacted, That this Act is hereby
declared to be an emergency law and necessary for the imme-
diate preservation of the public health and safety and hav-
ing been passed by a yea and nay vote, supported by three-
fifths of all the members elected to each of the two Houses of
the General Assembly, the same shall take effect from the
date of its passage.
