CHAPTER 379.
(Senate Bill 133)

AN ACT to add a new section to Article 4 of the Code of
Public Local Laws of Maryland and Baltimore City
Charter (1938 Edition), said new section to be known as
Section 878A and to follow immediately after Section
878 of said Article, relating to the classification and com-
pensation of certain Detective Patrolmen and Patrol-
men assigned to the Bertillon Bureau,

CHAPTER 380.
(Senate Bill 147)

AN ACT to repeal and re-enact with amendments Section
5 of Article 35 of the Annotated Code of Maryland (1924
Edition), title "Evidence", sub-title "Competency of
Witnesses", relating to testimony by certain persons
when called by an adverse party.

SECTION 1. Be it enacted by the General Assembly of
Maryland,
That Section 5 of Article 35 of the Annotated
Code of Maryland (1924 Edition), title "Evidence", sub-
title "Competency of Witnesses", be and it is hereby re-
pealed and re-enacted with amendments to read as follows:

5. In any suit, action or proceeding at law or in equity
in any Court of this State, any party may call as a witness
any adverse party or any officer, director or managing
agent of a public or private corporation or of a partnership
or association which is an adverse party, and interrogate
him by leading questions and contradict and impeach him
in all respects as if he had been called by the adverse party.
