CHAPTER 285.
(Senate Bill 338)
AN ACT to repeal and re-enact, with amendments, Section
507B of Article 12 of the Code of Public Local Laws of
Maryland (1930 Edition), title "Garrett County", sub-
title "Sunday Observance", as said section was enacted
by Chapter 3 of the Acts of 1937, relating to the disposi-
tion of certain license fees received for the exhibition of
motion pictures on Sunday in the town of Oakland, in
Garrett County.
SECTION 1. Be it enacted by the General Assembly of
Maryland, That Section 507B of Article 12 of the Code of
Public Local Laws of Maryland (1930 Edition), title
"Garrett County", sub-title "Sunday Observance", as said
section was enacted by Chapter 3 of the Acts of 1937, be
and it is hereby repealed and re-enacted, with amendments,
to read as follows:
507B. Upon every person, firm or corporation exhibit-
ing motion pictures pursuant to the preceding section for a
direct or indirect admission fee or charge, there is hereby
levied and imposed a tax at the rate of five (5c) cents for
each person admitted to any such exhibition. Said tax
shall be paid by said exhibitor not later than the Wednesday
following such exhibition, to the City Clerk of Oakland,
who shall pay all such taxes into a special account which
shall be divided and disbursed as follows: Twenty-five
per cent (25%) to the support and maintenance of the Oak-
land Free Public Library; twenty-five per cent (25%) to
the support and maintenance of the Oakland Volunteer
Fire Department and fifty per cent (50%) to the Garrett
County representative or agent of the Maryland Children's
Aid Society to be used for the aid of indigent children in
Garrett County, but in the event said Society shall cease to
operate in Garrett County and to have a representative or
agent in charge of children's work in said County, then the
said fifty per cent (50%) shall be paid to the Garrett
County Chapter of the American Red Cross, to be used for
the aid of indigent children in Garrett County. In
December of each year, the Garrett County Chapter of the
American Red Cross shall publish in a newspaper circulat-
ing in Garrett County an account showing the expenditure
of the funds received during the preceding year pursuant
to this Section. If said Chapter fails to publish such an
account in any year, said fifty per cent (50%) shall there-
after be paid into the general funds of the County.
