119. The provisions of this Act, shall not apply to sales at
retail or sales at wholesale (a) where merchandise has been
purchased at a forced, bankrupt, close-out sale, or other sale
outside of the ordinary channels of trade and is kept separate
from merchandise purchased in the ordinary channels of
trade, and advertised, marked and sold as such, and the adver-
tisement shall state the quantity of such merchandise to be
sold or offered for sale; (b) where merchandise is sold in bona
fide clearance sales, if advertised, marked, and sold as such
and the advertisement shall state the quantity of such mer-
chandise to be sold or offered for sale; (c) where perishable
merchandise must be sold promptly in order to forestall loss;
(d) where merchandise is imperfect or damaged or is being
discontinued and is advertised, marked and sold as such and
the advertisement shall state the quantity of such merchandise
to be sold or offered for sale; (e) where merchandise is sold
upon the final liquidation of any business; (f) where mer-
chandise is sold for charitable purposes or to relief agencies;
(g) where merchandise is sold on contract to departments of
the government or governmental institutions; (h) where the
price of merchandise is made in good faith to meet competi-
tion; (i) where merchandise is sold by any officer acting under
the order or direction of any court.

120. If any section, sentence, clause or provision of this
Act shall for any reason be held invalid or unconstitutional,
the validity of the remaining parts hereof shall not be affected
thereby.

SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1939.

(House Bill 140)

AN ACT to repeal and re-enact, with amendments, Section 9
of Chapter 197 of the Acts of the General Assembly of 1931,
to provide for an increase in the borrowing power of The
Mayor and Common Council of Seat Pleasant for public
improvements in the Town of Seat Pleasant; and to add a
new section to Chapter 197 of the Acts of the General As-
sembly of 1931 to be known as Section 16, authorizing The
Mayor and Common Council of Seat Pleasant to levy a
